Terms of Use

Last updated: October 13, 2026.

These Terms of Use (“Terms”) govern access to and use of the Dizzi platform (“Platform” or “Dizzi”), a customer service, automation and campaign service delivered over messaging channels and offered as subscription software (SaaS). By creating an account, or by accessing or using the Platform, you state that you have read, understood and agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Platform.

1. Definitions

  • User or Customer: the individual or company that creates an account and subscribes to the Platform.
  • Workspace: the Customer’s environment within the Platform, with its contacts, channels, team and settings.
  • Contacts: the people the Customer communicates with through the Platform.
  • Channels: third-party services connected to the Platform, such as WhatsApp, Instagram, Messenger, Telegram, SMS and email.
  • Customer Content: all data, messages, files, templates, knowledge bases and other information entered or transmitted by the Customer on the Platform.

2. Acceptance and capacity

To use the Platform you must have full legal capacity and be over 18 years old. If you use the Platform on behalf of a company, you state that you have authority to bind it to these Terms, and “Customer” then refers to that company.

3. The service

Dizzi lets you, among other features, bring conversations from different channels into a shared inbox, automate replies and flows, build chatbots with artificial intelligence, send campaigns, manage contacts, schedule posts and generate reports. The features available, and their usage limits, depend on the plan you subscribe to and may be improved, changed or discontinued over time, as provided in section 17.

4. Account, access and security

  • You must provide accurate, complete and current information when you sign up, and keep it that way.
  • You are responsible for keeping your password and access credentials confidential, as well as those of every user and integration you authorize. We recommend turning on two-step verification.
  • All activity under your account is your responsibility. Report any unauthorized use right away at [email protected].
  • You may not share the account with anyone outside your organization, or resell or sublicense access to the Platform without written authorization.

5. Plans, prices and payment

  • Plans, their limits and prices are described in the commercial proposal accepted by the Customer (or on the pricing page, when there is one) and at the time of purchase. The limits of each plan (for example, number of users, messages, WhatsApp accounts, campaigns and artificial intelligence usage) are part of the offer.
  • Billing is recurring, monthly or annual depending on the cycle you choose, and is processed by third-party payment gateways. The subscription renews automatically at the end of each cycle until it is canceled.
  • Applicable taxes, fees and charges may be added to the price, as required by law.
  • Prices may be adjusted. Price changes for subscriptions already in progress will be announced at least 30 (thirty) days in advance and will apply from the next cycle, and the Customer may cancel before the change takes effect.
  • Third-party costs are not included. Amounts charged by channel providers (for example, WhatsApp conversations charged by Meta), by SMS providers, by bulk email providers and by artificial intelligence providers the Customer contracts directly are the Customer’s responsibility and are paid to those providers.
  • If a payment fails, we will try to charge again and may limit or suspend features until the payment is settled, without prejudice to collecting the amounts owed.

6. Trial period

Some plans may include a free trial, and its length is stated in the offer. When the trial ends, the subscription is billed according to the plan you chose, unless you cancel before the period is over. We may limit trials to one per Customer or per company.

7. Cancellation and refunds

  • You can cancel the subscription at any time in the billing area of the Platform. Canceling prevents new charges; access continues until the end of the cycle you already paid for.
  • Right of withdrawal. Where the Customer is a consumer, under article 49 of Brazil’s Consumer Defense Code, you may withdraw from the purchase within 7 (seven) calendar days after the first charge and receive a full refund of the amount paid.
  • Outside the case above, amounts already paid for a cycle in progress are not refundable on a pro rata basis, except where the law provides otherwise and in cases of proven serious failures in providing the service.
  • After the account is closed, Customer Content is handled as described in the Privacy Policy. We recommend exporting your data before closing the account.

8. Acceptable use

You agree to use the Platform in accordance with the law, these Terms and the policies of the Channels you use. The following is expressly prohibited:

  • sending unsolicited bulk messages (spam), or sending messages to people who have not given consent or for whom you have no other valid legal basis to send the communication;
  • sending content that is illegal, fraudulent, misleading, defamatory, discriminatory, that violates the rights of others or that incites violence or crime;
  • collecting, processing or sharing personal data in violation of applicable data protection law;
  • trying to access areas or accounts without authorization, reverse engineering, overloading the infrastructure, introducing malicious code or bypassing limits and security mechanisms;
  • using the Platform for activities that violate the terms of Meta (WhatsApp, Instagram and Messenger) or of any other channel provider;
  • using the Platform for purposes that compete directly with Dizzi through misuse of information or access.

You are solely responsible for the messages you send, for obtaining your Contacts’ consent and for complying with the rules that apply to your business.

9. Channels and third-party services

  • Dizzi integrates with third-party services, such as Meta (WhatsApp, Instagram and Messenger), Telegram, SMS and email providers, payment gateways and artificial intelligence providers. Those services are governed by their own terms, prices and policies, and the Customer states that they know and accept them.
  • We do not control those services and are not responsible for their outages, rule changes, restrictions, suspensions or account blocks.
  • WhatsApp channel by QR code. The QR code connection works in an unofficial way, as a linked device, and is not supported by Meta. Using it may result in the number being restricted or banned, and it is done at the Customer’s own risk. For critical operations, we recommend the official WhatsApp Business API.

10. Customer content and data

  • Customer Content is and remains the Customer’s property. You grant us a limited, non-exclusive license to host, process, transmit and display that content as needed to provide the service.
  • For the personal data of your Contacts, the Customer acts as the controller and Dizzi as the processor, handling the data according to the Customer’s instructions and the Privacy Policy. The Customer is responsible for informing data subjects and for having a legal basis for the processing.
  • You can export your workspace data from the Platform, subject to the features available.

11. Intellectual property

The Platform, its code, design, trademarks, logos and documentation are owned by Dizzi or its licensors and protected by applicable law. These Terms give the Customer only a personal, limited, revocable and non-exclusive right of use for as long as the subscription lasts. No ownership rights are transferred.

12. Artificial intelligence features

Artificial intelligence features generate replies automatically and may contain errors, inaccuracies or inappropriate content. The Customer is responsible for setting up, reviewing and supervising chatbots and automations, and for the messages sent to its Contacts. Content may be processed by artificial intelligence providers configured by the Customer or by the Platform, as described in the Privacy Policy.

13. Availability and support

We use reasonable efforts to keep the Platform available and secure, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates and outages may happen, including ones caused by third parties. Support is provided through the channels shown on the Platform and at [email protected], depending on the plan.

14. Suspension and termination

We may suspend or end access, in whole or in part and immediately, if these Terms are violated, if use puts the security or continuity of the service at risk, if there is a legal order, or if payment is overdue. Where possible and appropriate, we will notify the Customer. The Customer may close its account at any time. Clauses that by their nature should survive termination will remain in force.

15. Limitation of liability

  • The Platform is provided “as available”. To the fullest extent allowed by law, Dizzi is not liable for indirect damages, lost profits, lost opportunities or lost data resulting from improper use, third-party failures, account blocks on Channels or events beyond our reasonable control.
  • Where liability exists, it will be limited, to the extent allowed by law, to the amount actually paid by the Customer in the 12 (twelve) months before the event that caused the damage.
  • Nothing in these Terms excludes or limits liability that the law, including consumer protection law, does not allow to be excluded or limited.

16. Data protection

The processing of personal data is governed by the Privacy Policy and by applicable data protection law (in Brazil, where the company operates, the General Data Protection Law, LGPD). The use of cookies is described in the Cookie Policy, available in Portuguese at /p/politica-de-cookies.

17. Changes to these Terms and to the Platform

We may update these Terms to reflect legal, technical or commercial changes. Material changes will be announced by email or on the Platform at least 30 (thirty) days in advance. Continued use after the effective date means acceptance; if you disagree, the Customer may cancel the subscription before the change takes effect.

18. Notices

Notices about the service will be sent to the registered email address or shown on the Platform. The Customer is responsible for keeping its contact details up to date.

19. General provisions, governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. If a clause is found invalid, the others are not affected. Tolerating a breach of any provision is not a waiver. The courts of the Customer’s place of residence are chosen to settle disputes, except where the law sets another competent venue.
